ERB implementation roadmap now published
Earlier this week the government published an update on the phased approach to implementing the Employment Rights Bill (ERB).
Weβve been waiting for clarity on the rollout of these changes for a while, and it seems that some are due a lot later than first anticipated, giving businesses a bit more time to digest it all and prepare.
Hereβs the highlights from their implementation roadmap:
Immediate ERB updates (awaiting Royal Assent)
π Repeal of the Strikes (Minimum Service Levels) Act 2023
π Repeal of major parts of the Trade Union Act 2016
π New protections against dismissal for taking part in industrial action
ERB updates coming in April 2026
π Day 1 rights to paternity and unpaid parental leave
π Removing the waiting period and lower earnings limit for SSP
π Enhanced protection for whistleblowers
π Creation of the new Fair Work Agency
π Simplified trade union recognition
π Simplified trade union balloting systems (digital & workplace)
π Doubling the maximum period of the collective redundancies protective award

π Extended trade union rights
π Ban on fire and rehire
π Tightening of current tipping law
π Employer duty to take all reasonable steps to prevent sexual harassment
π Changes to employment tribunal time limits
